Driving School Service Terms
This document constitutes the written terms between the school and the student. Oral statements or promises are not recognized.
By submitting an enrollment or completing payment, the student or their legal guardian is deemed to have read, understood, and accepted all terms of this contract.
Important Terms Summary (if inconsistent with the main text, the main text prevails)
• You must read this entire contract yourself. Failure to read it, failure to see it clearly, or later claiming you did not see it does not excuse you from the terms.
• Refund if no services have been received: 10% of the total order price is deducted. If services have already started: official list prices of used items are also deducted; the remainder is refunded via the original payment method.
• All services are valid for one year from the date enrollment is established. Unused portions expire and cannot be extended. The school will not send additional reminders.
• Cancellation or rescheduling requires at least 24 hours’ notice, and you must notify both official customer service and the instructor for that session. The office is closed on Sundays, but you must still notify the instructor.
• Courses are for the enrolled student’s personal use only and cannot be transferred or applied toward other services. Remaining services expire immediately after passing the road test.
1. Enrollment and Refunds
1.1 Enrollment is established after checking the box, enrolling, and paying. Items, quantities, and amounts are based on the order, receipt, and the school’s official list prices.
1.2 If a refund is requested before any services have been received, regardless of reason, the school charges 10% of the total order price as an enrollment fee and refunds the remainder.
1.3 Once any paid service has started (including lessons already taken, reservations made, road-test slots reserved, or an instructor or test vehicle already dispatched), if you then withdraw, the school deducts:
(1) the official list price of services already provided or deemed provided; and
(2) 10% of the total order price as an enrollment fee.
The remainder is refunded. If the amount to be deducted is not less than the total paid, there is no refund.
1.4 The following are treated as the service having been provided and are fully counted under 1.3(1): cancellation or rescheduling without at least 24 hours’ notice and simultaneous notification as required in Section 4; arriving more than 15 minutes late without prior notice to that session’s instructor; inability to take the lesson or road test due to incomplete documents, permits, items, or reasons attributable to the student.
1.5 Eligible refunds under this section will be returned via the original payment method.
2. Validity Period
2.1 All services are valid for one year from the date enrollment is established. Unused portions automatically expire at the end of the period and cannot be extended, frozen, or restored.
2.2 The validity period runs from the enrollment date whether or not services have begun. Students must track the expiration date themselves. The school has no obligation to send expiration reminders; lack of a reminder is not grounds for extension or refund.
2.3 After passing the road test, all services end. Unused lessons may still be used for practice driving (within the original service validity period) or applied at $50 per 90 minutes toward purchase of highway lessons. Highway lesson prices follow the then-current price list.
3. Non-Transferability and Course Offsets
3.1 All courses and services are for the paying student’s personal use only and cannot be transferred, lent, or taken by someone else.
3.2 Unused lesson hours or services cannot be cashed out or applied toward other paid items.
3.3 The school is only responsible for courses purchased through the official website and confirmed by official customer service. Third-party purchases, personal verbal statements, screenshots, or unofficial promises are not binding on the school.
4. Reservations, Cancellations, Rescheduling, and Lateness
4.1 All lessons must be reserved in advance and take effect only after school confirmation. Communications regarding reservations, cancellations, and rescheduling must be in writing and kept by the student as the record of mutual confirmation.
4.2 Cancellation or rescheduling requires at least 24 hours’ notice and simultaneous notification of official customer service and that session’s instructor. Notification must use a school-approved written method (text message or WeChat) and is effective only when both customer service and the instructor have actually received it.
4.3 The office is not open to the public on Sundays. Cancellations or rescheduling on Sundays or outside office hours still require at least 24 hours’ notice to that session’s instructor, plus follow-up notice to customer service during the next office period. Notifying only one party or giving less than 24 hours’ notice is treated as failure to cancel according to the rules.
4.4 Failure to cancel or reschedule according to the rules means that service is treated as used and deducted. No makeup lesson, rescheduling, or refund will be given.
4.5 Arriving more than 15 minutes late on the lesson day without prior written notice to that session’s instructor is treated as forfeiting that lesson. The instructor may leave or take another assignment. The lesson is deducted with no makeup or compensation.
5. Road Test, Vehicle, and Instructor
5.1 The school may assist with scheduling a New York State DMV road test and, within the agreed scope, provide a test vehicle and accompaniment. If the student schedules independently and not through the school, the school may decline to provide a vehicle or accompaniment.
5.2 The school will try to arrange a suitable instructor and a vehicle that meets DMV requirements, but does not guarantee the same instructor or same vehicle for practice and the road test, or that the test vehicle will match the usual practice vehicle. Road-test times are coordinated by the school. Special time requests should be made to customer service in advance; the school’s actual arrangement prevails. In case of vehicle, staff, traffic, weather, or test-site scheduling issues, the school may change the instructor or vehicle. Students who use their own vehicle for the road test must arrange their own accompanying person who meets DMV requirements. Any test appointment made by the school still counts as one paid exam service already provided.
5.3 On road-test day, the student must bring all required documents and be prepared according to official New York State DMV published requirements, and arrive at the test site at least 30 minutes early. The school does not provide transportation. Minors require written authorization from a guardian. Failure to test or failure to pass due to inadequate preparation, lateness, or not meeting that day’s test-site requirements is the student’s responsibility.
5.4 Whether the road test proceeds, is passed, is stopped, cancelled, or refused on the spot is determined by the New York State DMV and the examiner that day. Regardless of documents, vehicle inspection, test-site rules, examiner judgment, policy or system arrangements, or other reasons the student believes relate to the school’s arrangements, if the road test is not allowed to proceed or is not completed, the school is not responsible for the uncompleted test. The arranged vehicle and accompaniment are still treated as services provided. If the test cannot be taken due to the school’s vehicle or arrangements, the school will reschedule free of charge and arrange expedited exam service as compensation.
6. 5-Hour Pre-Licensing Course
6.1 The school may introduce 5-hour safety course providers so students can compare and choose. Whether to enroll and which provider to use is the student’s decision.
6.2 Class times, certificates or completion proofs, and other matters should be handled directly with that provider. The school does not handle related matters for this course.
6.3 Before taking the road test, confirm yourself that you have completed this course and have a valid course certificate, completion confirmation email, or other completion proof recognized by the DMV.
7. Scope of School Services
7.1 The school’s work is driving instruction and, within the agreed scope, assistance with test scheduling and accompaniment. License applications, address changes, document mailing, DMV accounts, and test-site rules are the responsibility of the New York State DMV and must be handled by the student through official channels.
7.2 The school and instructors may give reference advice on practice and test scheduling based on teaching experience, for the student to judge in light of their own situation. Whether and when to schedule a test is the student’s final decision.
8. Safety and Limitation of Liability
8.1 During lessons and accompaniment, do not drink alcohol, take medications that impair driving, or engage in behavior that affects safety. To protect safety, the instructor may stop that session; the lesson hours still count as used.
8.2 Driving training and road tests involve traffic and personal risk. To the extent permitted by law, the student and their guardian understand and agree that the school, instructors, and staff are not liable for losses arising from normal instruction or accompaniment that are not caused by intent or gross negligence.
8.3 Tips are voluntary and are not included in course fees.
9. Force Majeure
9.1 In the event of weather, DMV or test-site arrangements, sudden vehicle or staff issues, public events, or other circumstances beyond the school’s control, lessons or road tests may need to be rescheduled. The school will assist with rescheduling as soon as possible and will not pay additional compensation for this.
9.2 If the DMV cancels the original road test and reschedules it, and the school cannot provide a suitable vehicle or instructor on that new date, the school will coordinate another time.
